For Respondent/State Mr. Ashok Swarnkar, PL Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 2-111. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.
2. The applicant has been arrested in connection with Crime No. 469/2018 registered in police station City Kotwali, Dhamtari, Distt. Dhamtari (CG) for offence punishable under Section 34(2) of Excise Act.
3. Arguments heard.
4. Prosecution story in brief is that on 7-10-2018, 5.400 bulk litre country liquor has been seized from the applicant.
5. Govt. Advocate submits that 3 more criminal cases have been already registered against the applicant.
6. Looking to the above facts and circumstances of the case, application is allowed. It is ordered that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- each along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with condition that he will not commit any offence in future, he be released on bail.
