1. The petitioner who is working as Patwari has been transferred from Tahsil Baramkela to P.H.No.21, Bhedi, Muda Tahsil Lailunga vide order dated 16.09.2019 (Annexure P-1) which is under challenge.

2. Learned counsel for the petitioner contends that the transfer order has been issued during ban period and as per the the Policy of the State, there is complete ban for transfer of an employee, therefore, the order is liable to be quashed.

3. Learned state Counsel submits that the transfer is within the district and the petitioner may file representation to redress his grievance.

4. Considering the fact that the transfer is within the District, it is directed that the petitioner shall make a representation to respondent no.2 within a period of 3 weeks and on such

representation being filed, the same shall be considered and decided within a further period of 60 days from the date of receipt of the representation.

5. Till the representation of the petitioner is decided, the impugned order (Annexure P-1) shall remain stayed if it has already not been given effect to.
