Shri D. Wankhede, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 19.11.2018 The relief sought for by the petitioner in the present writ petition is for a direction to the respondents to consider the representation of the petitioner seeking transfer to a place nearby Kawardha. 2.
The case of the petitioner is that he was substantively working as a Patwari in District Kawardha when he got promotion in January, 2018 on the post of Revenue Inspector. On promotion he was sent to District Mungeli. 3.
Counsel for the petitioner submits that the petitioner is the sole son of the family and he has to take care of his ailing father who is suffering from
cancer, therefore, he has to frequently visit his home to attend his ailing father. He submits that the petitioner has made a representation to the Department seeking for a suitable transfer back to either District Kawardha or a place nearby Kawardha. He further submits that the State Govt. has already reconsidered the place of posting in respect of many similarly placed persons.

Given the facts and circumstances of the case and also realising the limited scope of interference that this Court under Section 226 of Constitution of India has in such subject matter, it is left for the State Govt. to take a decision on the representation of the petitioner at the earliest preferably within a period of 60 days from the date of receipt of copy of this order.
