1. The grievance of the petitioner is that the petitioner is working as Village Health Coordinator at Village Sub Health Centre, Vicharpur, Block Development Kahiragarh, District Rajnandgaon to Sub Health Centre, Kewattola, Block Development, Mohla, District Rajnandgaon which is about 120 kms away. It is stated that the petitioner is a single women (divorcee) and she has served from 02.07.1989 to 2000 in Vicharpur, which is a scheduled area and she has been transferred. It is further contended that the Gram Panchyat, Vicharpur has also recommended for cancellation of

transfer of the petitioner which contains signatures of all the villagers, however, the same could not be considered by the Chief Medical Officer on the ground that the power of cancellation or modification of transfer is vested with the State Government.

Perused the documents and the recommendation made by the Gram Panchayat, Vichharpur wherein the transfer of the petitioner is in the fact that the petitioner is a low paid employee and also served in the scheduled area for a considerable period and it is directed that the petitioner shall file a representation to Respondent No. 1 within three weeks from the date of receipt of copy of this order. Thereafter, Respondent No.1 shall decide the same within a further period of 45 days, till then the transfer order of petitioner shall not be given effect to, if it has not been carried out till date.
