Grievance of the petitioner is that the petitioner is more than 55 years of age and she has been transferred from Integrated Child Development Project, Bilha, District Bilaspur to Integrated Child Development Project, Geedam, Dantewada, District Dantewada vide order dated 21/08/2019. It is stated that as per the policy of the State clause 1.5 the lady employee who are more than 55 years may not be transferred to the core schedule area and place of transfer wherein the petitioner has been transferred is a core schedule area, therefore the petitioner may not be transferred.

Perused the documents. The petitioner has admitted her date of birth to be 12/08/64. Perused the transfer policy of the State specially clause 1.5 wherein it is stated that lady who are more than 55 years they may not be transferred to core schedule area. Considering the fact, it is

directed that the petitioner shall make a representation within a period of three weeks from today to the concerned respondent. If such representation is filed, same may be decided within a further period of 45 days. Till then the transfer order dated 21/08/2019 in respect of the petitioner shall not be given effect to.
