Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 14-11. This is second bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 118/2007 registered in police station Bankimongra, Distt. Korba (CG) for offence punishable under Section 452, 323, 394/34, 353, 379, 398 of IPC.

3. Prosecution story in brief is that on 9-6-2007 the applicant along with other accused persons entered the house of one Rajesh Agrawal and looted the cash of Rs. 50,000 and jewelery.

4. Counsel for the applicant argued that the applicant is innocent and falsely implicated. The applicant is facing trial. He was granted bail by order of this Court. Subsequently he remained absent and on 28-6-2016, warrant of arrest was issued against him. In execution thereof, he was arrested and now he is in jail. He may be released on bail.

5. On the other hand, the Panel Lawyer appearing for the State opposed the bail application.

6. Looking to the above facts and circumstances of the case, the

application is allowed. It is ordered that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will appear before the concerned trial Court at 11 AM as and when directed till trial with a further condition that he will appear regularly before the trial Court and will not leave District Korba without obtaining permission of the trial Court, he be released on bail
