1. The grievance of the petitioner is that the petitioner has been transferred from Integrated Child Development Project, Bakawand, District Bastar to Integrated Child Development Project, District Dantewada.

2. It is contended that the petitioner has been transferred to core scheduled area i.e. Dantewada and as per Clause 1.5 of the transfer policy persons who are more than 55 years of age should not be transferred to core scheduled area. Therefore, the transfer made is against the transfer policy of the government.

3. Perused the transfer policy and according to clause 1.5 of the transfer policy the petitioner who is shown to be more than 55 years would be protected to be transferred to core scheduled area. These facts are to be ascertained and the petitioner shall be at liberty to file a representation to respondent No. 1 within 15 days from the date of receipt of copy of this order. The representation so made shall be decided within a further period of 45 days, if the transfer order of the petitioner has not been given effect to till date, the same may be stayed till the representation is decided.
