Grievance of the petitioner is that the petitioner working as Assistant Food Officer at North Baster, Kanker has been transferred to South Bastar on the administrative ground. It is stated that the petitioner is 59 years old and as per the transfer policy of the State person who are more than 55 years of age are not normally transferred to the core schedule area and South Bastar would fall under the core schedule area. It is further contended that as per clause 2.1 of the transfer policy person who have served more than three years in the schedule area are normally transferred to non schedule area and as per the clause 2.2 the petitioner has not exercised his option to be posted in other schedule area. 2.
Perused the document as also clause 1.5, 2.1 and 2.2 of the transfer policy. Considering the age of the petitioner and the fact that the petitioner is said to have served in the schedule area for more than 5 years, the petitioner is given liberty to make a representation to the
Grievance Redressal Committee constituted by the State to hear the case of transfer within a period of three weeks from today. If such representation is filed, same may be decided within a further period of 45 days. Till then the transfer order dated 11/10/2019 in respect of the petitioner shall not be given effect to.
