The grievance of the petitioner in the instant Writ Petition is that, the respondent No.4 being much junior to the petitioner has been promoted to the post of Senior Auditor ignoring the claim of the petitioner. 2.
The counsel for the petitioner submits that, from the gradation list as also from the seniority list maintained in the department it would clearly reflect that the petitioner was senior to the respondent No.4. How the respondent No.4 has been given promotion ahead of the petitioner has not been intimated to the petitioner till date by the authorities. He further submits
that, the petitioner has also made a representation in this regard to the respondent No.3 which still stands undecided. 3.
In the given facts, let the petitioner make a fresh representation to the respondents No.2 & 3 within a period of 3 weeks from the date of receipt of certified copy of this order and the respondents No. 2 & 3 in turn shall decide the same on due verification of the facts as to whether the petitioner and the respondent No.4 are similarly placed and whether they belonged to the same cadre and whether the petitioner also has all the eligibility criteria as that of the respondent No.4 and pass an appropriate order at the earliest preferably within a period of 3 months from the date of receipt of certified copy of this order.
