Hon'ble Shri Justice Goutam Bhaduri Order on Board -10-2019

1. The petitioner who is working as Assistant Professor Sociology in Govt. P.G. Arts/Science College, Durg has been transferred to Govt. Navin Mahavidyalay, Mahud, Distt. Balod vide impugned order dated 21.08.2019 (Annexure P-1) which is under challenge. It is contended that the petitioner is aged about 60 years and is suffering from various ailments which would be evident from documents annexed to the petition. The primary objection is that her husband was posted at Govt. College Bori, District Durg and since then he is working there and as per the State Transfer Policy as far as practicable the wife and husband are kept in the same place.

2. The petitioner relies on certain medical documents to support the ground of ailment. Considering the fact that the husband of the petitioner is working in District Durg and as per the State Policy, the husband and wife are normally kept at place, the petitioner shall be at liberty to make a representation before respondent No.1/ Grievance Redressal Committee within a period of 15 days from the date of receipt of the order and on such representation being filed, the same shall be considered and decided within a further period of 45 days.

3. Till the representation of the petitioner is decided is decided, the impugned order shall remain stayed if the petitioner has already not been relieved.
