The petitioner would submit that his land has been encroached by the respondent and an application moved before the Tehsildar has not been considered.

If the land owned by the petitioner is agricultural land, the petitioner has remedy under Section 250 of the Chhattisgarh Land Revenue Code, 1959 for removal of encroachment. If the

land is in the urban area, the petitioner has remedy of filing a civil suit for recovery of possession.

Let the petitioner avail the alternative remedy available to him. 4.
