Shri Kamlesh Kumar Mishra Principal Government New College Fasterpur, (Satganga), District Mungeli, Chhattisgarh. ---Respondents For Petitioner :

For Respondent :

Shri Saleem Kazi, Advocate.

Hon'ble Shri Justice P. Sam Koshy Order on Board 14.08.2019

1. The present contempt petition has been filed alleging non compliance of the order dated 02.08.2018 passed by this court in WPS No.4957 of 2018.

2. Learned counsel appearing for the respondent submits that he has specific instructions to submit that the case of the petitioner herein has not been considered for the specific reason of the petitioner having criminal antecedent, inasmuch as, there are couple of criminal cases lodged against the petitioner at different police stations and it was for this reason that the petitioner's services could not be extended whereas, the order has been complied with so far as other petitioners (in the main writ petition) are concerned.

3. Given the submissions made by the counsel for the respondent, this court is of the firm view that the decision of the respondents in not considering the case of the petitioner cannot be brought within the ambit of a contempt of court when they have specific reasons for not considering the petitioner's claim for appointment as guest faculty. The petitioner, if at all, is aggrieved by the decision of the respondents in not continuing his

-2services as guest faculty, he would be at liberty to challenge the same either by way of a fresh writ petition or may move an appropriate application in the pending writ petition.

4. The contempt petition accordingly stands disposed off. Sd/- (P. Sam Koshy) Judge inder
