Smt. Shashi Kala Bhuwal v. Praveen Kumar
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Criminal Revision No. 1317 of 2018 Smt. Shashi Kala Bhuwal W/o Praveen Kumar Bhuwal, aged about 42 years R/o C/o Shri Kamta Singh Thakur, Mamta Nagar Main Road, Ward No. 19, Near Railway Under bridge Service Road, District Rajnandgaon (Chhattisgarh) ----Applicant
Versus
Praveen Kumar Bhuwal S/o Lt. Shri Brijmohan Singh Bhwal, Aged about 47 years R/o Quarter No. 1/A, Road 21 Sector 06 Bhilai Nagar, Distt. Durg (C.G.). ---- Respondent For Applicant :
Mr. Pragalbha Sharma, Advocate For Respondent :
Mr. Jaydeep Singh Yadav, Advocate Hon'ble Shri Justice Arvind Singh Chandel Order on Board 08/02/2019 1.
With the consent of both the parties, the matter is heard finally. 2.
This revision has been preferred by the Applicant/Wife against order dated 03/10/2018 passed in MJC No. 143/2017 by the Family Court, Rajnandgaon, whereby the Family Court awarded monthly interim maintenance of Rs. 500/- in favour of the Applicant/Wife. 3.
There is no dispute on the point that the Applicant is legally wedded wife of the Respondent. Though as pleaded by the Respondent, he got a decree of divorced against the Applicant, she has not re-married, therefore, she is entitled to get maintenance from her divorced husband/Respondent. The learned Family Court has granted monthly interim maintenance of Rs. 500/- only in favour of the Applicant. A salary slip of the month of December, 2018 has been filed by the Respondent himself, which shows that in the month of December, 2018, the Respondent was withdrawing a monthly salary of Rs. 33177/- after all deduction. Therefore, considering
the above, Rs. 500/- interim maintenance awarded by the Family Court is on lower side.
4.
Considering the facts and circumstances of the case, further considering the financial status of both the parties, particularly monthly salary slip of the Respondent, the interim maintenance of Rs. 500/- is enhanced to Rs. 6000/- in favour of the Applicant/wife. The above enhancement shall be effective from the date of order passed by the Family Court. 5.
Consequently, this revision is allowed.
