1. The present contempt petition has been filed alleging non compliance of the order dated 22.11.2018 passed by this court in WPS No.3356 of 2007. The direction given by this court was for the respondent No.1 to forthwith open the sealed cover so far as the recommendations made by the DPC held on 02.04.1994 and to take an appropriate steps thereafter.

2. Learned counsel appearing for the respondent No.1 today showed an order dated 24.01.2020 wherein it has been reflected that the order dated 22.11.2018 passed by this court has been duly considered and the sealed cover was opened and the authorities found that the DPC had not recommended the case of the petitioner for promotion.

3. Given the said submission by the respondent No.1, this court is of the opinion that by passing the order dated 24.01.2020, the order passed by this court on 22.11.2018 stands duly complied with. In case if the petitioner aggrieved of the said order dated 24.01.2020, the petitioner would be at

-2liberty to challenge the same by way of a fresh proceeding, as the veracity of that order cannot be tested under the contempt jurisdiction of this court.

4. Accordingly, reserving aforesaid right of the petitioner, the contempt petition stands disposed of.
