Shri Anand Verma, Dy. Govt. Advocate Hon'ble Shri Justice Arvind Singh Chandel Order on Board 26.11.2019 1.
Heard on admission. Perused the material available. 2.
Before the 2nd Additional Sessions Judge, Sakti, a trial under Sections 365, 201 and 302 of the Indian Penal Code, being Sessions Trial No.26 of 2018 is going on against present Petitioner Laxman Prasad Chandra and is pending at the stage of defence evidence.
3.
The instant transfer petition has been preferred on the ground that the Presiding Officer has made a comment that she will punish the present Petitioner and, therefore, he has no expectation of justice from the said Court. According to the Petitioner, at the time when the Presiding Officer made the said comment, Counsel for the Petitioner was present in the Court. But, no affidavit of a Counsel has been submitted by the Petitioner in this regard and also for the
reason that the matter is at last stage, I am not inclined to transfer the case.
4.
Accordingly, the instant transfer petition is dismissed at the admission stage itself.
