1. This is the third bail application preferred by the applicant under Section 439 of CrPC for grant of bail, as he is arrested in connection with Crime No.265/2017, registered at Police Station Mahasamund, District Mahasamund, for the offence punishable under Section 302 of IPC.

2. The first bail application was dismissed on 29.11.2017 in MCRC No.6477/2017 by a detailed order reserving liberty to

MCRC No. 7047 of 2019 move again after examination of witnesses Ashalata, Vijaya Das and Padma Das. The second bail application was also dismissed on 10.09.2018 in MCRC No.6281/2018 on merits. In the present third bail application there is no change in the circumstances and hence I am not inclined grant bail to the applicant.

3. Accordingly, the third bail application is rejected, however, the trial Court is directed to decide the trial expeditiously. In order to secure presence of witnesses, the trial Court shall take coercive steps which shall ensure warrant of arrest against witnesses.

4. Copy of this order shall be sent to the trial Court by tomorrow.
