1. The Applicant has preferred the second bail application under Section 439 of Cr.P.C. for grant of regular bail as he is arrested in connection with crime No. 316/2007, registered at Police Station- Chakarbhata, District- Bilaspur, (C.G.) for the offence punishable under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.
2. Initially vide order dated 13.08.2008 passed in MCRC No. 775 of 2008, first bail application under Section 439 of the Cr.P.C. has been submitted by the Applicant which has been allowed by this Court and Applicant was granted benefit of bail. During course of trial, Applicant was not present before the Trial Court, therefore, he was arrested on 14.10.2018. Since then, he is in custody.
3. Considering the facts and circumstances of the case and further considering the fact that initially Applicant had already been granted bail on 13.08.2008 and now he is in custody since 14.10.2018, therefore, I am of the view that the Applicant be enlarged on bail.
4. Accordingly, the bail application is allowed.
5. It is directed that the Applicant shall be released on bail on furnishing a personal bond for a sum of Rs. 20,000/- with one solvent surety for the like amount to the satisfaction of the concerned Trial Court for his appearance before the said Court as and when directed.
