Shri Rupesh Shrivastava, Advocate Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/01/2019 This contempt petition has been filed by the petitioner alleging willful disobedience of the interim order passed by this Court by which this Court directed that till the next date of hearing, the petitioner shall not be compelled to join pursuant to the impugned order. By impugned order, the petitioner was transferred to Beechpara.
Learned counsel submitted that the interim order is that the petitioner cannot be compelled to join at Beechpara or to perform any duty at Beechpara. Therefore, the letter issued to the petitioner by the respondent on 16/10/2018 appears to be without understanding the true spirit of the order of the Court. The respondent should therefore, withdraw the said order. If the petitioner is compelled to work at Beechpara or to join there, it would be treated as willful disobedience of the order of the Court.
