Shri D. Wankhede, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 04.01.2019 The present contempt petition has been filed alleging the willful noncompliance of the order dated 06.07.2018 passed by this Court in WPS No. 4424 of 2018.

Counsel appearing for the respondent has filed an affidavit intimating that due compliance of the order has been made in as much as except for retaining 10% of the pension, 90% pension has been released and other dues like leave encashment, GPF and Group Insurance have been paid to the petitioner. Counsel for the respondent submits that the balance 10% of pension is also under process as there are certain formalities which have

to be completed on the part of the petitioner. 3.

In view of the said affidavit given by the respondent, this Court is of the opinion that the order passed by this Court stands complied and honoured, therefore, there is no necessity for further proceeding with the contempt proceeding.

Accordingly, the present contempt petition stands disposed of and the respondent stands discharged from the contempt proceedings. However, in case the petitioner is aggrieved with any subsequent development, he would be at liberty to re-agitate the same by way of a fresh petition.
