1. The grievance of the petitioner is that the petitioner by order dated 01.10.2019 has been transferred from Government Primary School Basantpur, District Rajnandgaon to Government Primary School, Pushwada, Block Manpur, District Rajnandgaon.

2. It is stated that the petitioner belong to Nagriy Nikay cadre which is under Municipal Corporation, therefore, he cannot be transfered to any other institution which is not under the municipality. It is further contended that as per the Annexure P-2 dated 04.06.2001 the petitioner cannot be attached to other department. It is further contended that the petitioner is posted at

Basnatpur on 21.08.2019 and then in few months he has again been transferred, therefore, the transfer order with respect to the petitioner may be cancelled.

3. Perused the documents.

4. Considering the same, the petitioner shall be at liberty to file a representation to concerned respondent within 15 days from the date of receipt of copy of this order. The representation so made shall be decided within a further period of 45 days, if the transfer order of the petitioner has not been given effect to till date, the same may be stayed till the representation is decided.
