11.01.2019 Mr. Chandresh Shrivastava, Dy. A.G., for the State. Learned counsel for the petitioner raises an issue against the dismissal of application for discharge in P.C. Act. After perusal of the petition, it appears that ratio of law has already dealt with the similar issue raised in W.P (Cr.) No. 302/2017 (Gorelal Thakur v. State of C.G., and others) decided on 07.08.2018. In view of the same, the issue raised in this petition is no longer res-intergra as the said issue already stands concluded, which is not disputed by both the parties.
