The limited grievance which the petitioner has raised in the present writ petition is for direction to the respondents to consider and decide the representation which he has made in the light of the correspondence made by the Joint Commissioner, land Records dated 30/05/2018(Annexure P-1).

The case of the petitioner is that the petitioner had applied for the post of Patwari Training Selection Exam 2017. The petitioner's name reflected in the waiting list at serial No. 6, uptil the person at serial No. 5 already sent for training. However, later on the person whose name at serial No. 5 has resigned and left the training. Thus, the vacancy has arisen and therefore the petitioner had put forth his claim as the next person in the waiting list who should be sent for Patwari training. The petitioner had already made a representation to the authorities in the department and the representation has also been further forwarded by the Joint Commissioner, land records to the Collector, Surguja for taking appropriate decision.

Given the facts and circumstances of the case, the writ petition stands disposed off with direction to the respondent No. 4 to take a decision in this regard in accordance with the rules and regulations governing the field at the earliest preferably within a period of 45 days from the date of receipt of the order of this Court. It is made clear that this Court has not expressed any opinion on the merits, so far as the entitlement of the petitioner for the said training course is concerned. Respondent No. 4 would be at liberty to pass an order purely on its merits. The petitioner, in addition, is also entitled to file a fresh representation along with the copy of this order to the concerned authority.
