1. The short question arises for consideration is that the application of the petitioner for compassionate appointment has been rejected by the Assistant General Manager (DRM), Bank of Baroda.

2. The petitioner's husband who was working as Head Cashier has died in harness on 12.07.2018 at the age of 35 years. She applied for compassionate appointment in the Bank being legal heir/dependent of the deceased. However, the relief was denied on the ground that she was aged about 38 years and did not possess the requisite qualification.

3. Learned counsel for the petitioner would submit that the petitioner being the dependent is ready and willing to work on the lower post if she is granted compassionate appointment.

4. Earlier learned counsel for the respondents was directed to seek specific

instruction as to under what authority Annexure P-1 was passed by the Assistant General Manager (DRM). On instructions, it is submitted that the Bank is ready to reconsider the application of the petitioner and the authority who is empowered to decide such application is the Executive Director (H.R.).

5. Consequently the matter is remitted back to the respondents-Bank to reconsider the application of the petitioner for compassionate appointment by the competent authority according to the existing Policy and the Circulars of the Bank. The said exercise may be be carried out within a period of 4 months from the date of presentation of the order.
