The limited relief which the petitioner has sought for in the present writ petition is for a direction to the respondents to consider grant of subsistence allowance to the petitioner who is placed under suspension since 23.02.2017.

Given the nature of relief sought for, prima facie, this Court is of the opinion that if a person is placed under suspension, he is entitled for subsistence allowance.

Given the said fact, let the respondents take a decision on the claim of the petitioner so far as grant of subsistence allowance is concerned. If the petitioner is entitled under the rules, the same be released to the petitioner forthwith. If he is not entitled for the same, the petitioner be intimated about the same at the earliest preferably within a period of 45 days from the date of receipt of copy of this order. 5.
