This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicant has been arrested in connection with Crime No.400/2018 registered in Police Station Ratanpur, District Bilaspur (C.G.) for the offence punishable under Section 34(2) & 59(1) of CG Excise Act. 3.
Argument heard.

Case of the prosecution, in brief is that on 19/10/2018, 150 bulk liters of hand made country liquor has been seized from the possession of the applicant.

Counsel for the applicant submits that applicant is falsely implicated in the present case.

Counsel for the State submits that there is no antecedents of the applicant is reported in police case diary.

Looking to the above facts and circumstances of the case, looking to the huge quantity of seized hand made country liquor and looking to the impact of granting bail to the applicant on society, the present bail application is dismissed.
