2. By the impugned order, the defendant No.1's application for
amendment in the written statement has been rejected.

Taking into consideration the submissions of the parties and that the amendment appears to be just and proper for proper disposal of the suit, the amendment is allowed and defendant No.1 is permitted to amend the written statement within three weeks from today and the plaintiff will also be entitled to make consequential amendment in the plaint.
