1. The grievance of the petitioner is that the petitioner was in charge of the flying squad at Balod, Forest Division. The petitioner though is senior to Respondent No. 5 namely Shri Moolchand Sharma. Respondent No. 5 has been transferred by order dated 23.08.2019 and also given the charge of flying squad. It is contended that the petitioner being senior, the Respondent

No.5 cannot be given charge according to the circular of the State. It is not clear before this Court as to whether the petitioner has been removed and if the petitioner has been in the charge of flying squad, there is nothing on record to show that another person can not be given charge of flying squad. Further, there also is nothing on record to show that the charge from the petitioner has been taken away apart from the order of transfer dated 23.08.2019 and almost more than 4 months have been passed. Therefore, at this stage, I do not find any substantial issue to adjudicate as the petitioner or a government employee cannot claim the right to be posted at a particular post to discharge a particular job, it is the prerogative of the State to do so.
