1. The grievance of the petitioner is that the petitioner's wife who is a government servant was transferred according to the policy of the state to keep husband and wife at one place by order dated 21.08.2019 (Annexure P-3) however, the petitioner has been transferred from Community Health Center, Palari, District Balodabazar to Community Health Center, Gariyaband on administrative ground.

2. It is contended that the transfer of the petitioner's wife was done according to the policy of the State that the husband and wife has to be kept in one

place. The husband being transferred to another place the said policy is itself defeated.

3. Perused the documents. Perusal of Annexure P-3 shows that by order dated 21.08.2019 the wife of the petitioner was transferred from District Mahasamud to District Balodabazar on her own accord and on 19.08.2019 the petitioner himself has been transferred from Balodabazar to Gariyaband.

4. Considering the fact, it is directed that the petitioner shall make a representation within a period of 15 days from the date of receipt of a copy of this order to the respondent No.1. If such representation is filed, same may be decided within a further period of 45 days and if any other person has not joined in place of petitioner till date, the transfer order of the petitioner shall not be given effect to, till the representation is decided.
