For State :

Hon'ble Shri Justice P. Sam Koshy Order on Board 06/12/2018 1.

The limited prayer which the petitioner has made through the instant Writ Petition is for issuance of direction to the respondent No.2 to take a decision on the second appeal which the petitioner has preferred. 2.

It is a case where the petitioner has been inflicted with a punishment of removal from service vide Annexure-P/2 dated 21/06/2004. 3.

The first appeal of the petitioner stood rejected vide order dated 04/05/2018 and thereafter the petitioner has preferred the second appeal

before the respondent No.2 which till date has not been decided and is still pending.

4.

The counsel for the petitioner prays that the respondent No.2 may be directed to decide the second appeal at the earliest. 5.

Given the aforesaid facts and circumstances of the case, this Court is of the opinion that, no fruitful purpose would be served in keeping the Writ Petition pending, rather ends of justice would meet if the Writ Petition is disposed off with a direction to the respondent No.2 to decide the second appeal of the petitioner that he has preferred on 23/06/2018 Annexure-P/1 - at the earliest preferably within a period of 60 days from the date of receipt of the copy of this order.
