Hon'ble Smt. Justice Rajani Dubey Order on Board 20/12/2019 • The accused/applicant has moved this first bail application under Section 439 of the Code of Criminal Procedure for releasing her on regular bail during trial in connection with Crime No. 346/2019 registered at Police Station Mova (Pandri) Raipur (C.G.) for the offence punishable under Sections 147, 148, 149, 186, 332, 324, 353, 294, 506, 34 of IPC.
• According to the prosecution story, on 31.08.2019, police officials raided to arrest the absconding offender Yasin Ali but, on his call, approximate 25 ladies of the Irani Dera came there and assaulted the police with the help of stick, fist and tooth and tore up the uniform of the police authorities and daring the said incident, the said offender Yasin Ali fled away, thereby the present applicant committed the alleged offence. • Learned counsel appearing on behalf of the applicant submits that the applicant is innocent and has been falsely implicated in
the case. He further submits that all other co-accused have already been granted bail by this Court on 03.12.2019 in MCRC Nos. 7081/2019, 7114/2019, 7248/2019, as applicant is in custody since 31.08.2019 and she is ready to furnish adequate surety and shall abide by all the directions and conditions imposed upon her by this Court, therefore, she may be released on bail.
• Per contra, learned counsel appearing on behalf of the State opposes the bail application.
• I have heard learned Counsel for the parties. • Considering the facts and circumstances of the case, nature and gravity of the crime and further considering that all the coaccused persons have already granted bail by this Court, trial is likely to take some time, without further commenting on merits of the case, I am inclined to release her on bail. • Accordingly, the bail application is allowed. • It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 25,000/- with one surety for the like amount to the satisfaction of the trial Court for her appearance before the said Court as and when directed.
