This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.22 of 2019, registered at Police Station - Ajak Baikunthpur, District - Koriya, Chhattisgarh for the offence punishable under Sections 363, 366(A), 342 and 376(2)(jha) of the Indian Penal Code and Sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012.

Learned counsel for the applicant submits that the applicant is in jail since 8.7.2019 and has been falsely implicated in this case. No case is made out against the applicant on the basis of the material placed before the
Court by the prosecution. Hence, it is prayed that the applicant be enlarged on bail.

On the other hand, learned counsel for the State opposes the bail application and the submissions made in this respect. It is submitted that looking to the nature of allegation against this applicant, he is not entitled for grant of bail.

Heard counsel for both the parties and perused the case diary. 5.
According to the prosecution case, it is alleged that this applicant allured the minor prosecutrix of age about 16 years with a false promise to marry her and then exploited her sexually regarding which, the FIR has been lodged. The prosecutrix is also a member of Scheduled Tribe. 6.
After considering the nature of allegation and other facts and circumstances of the case, I do not find any reason to allow this bail application.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
