Hon'ble Shri Justice P. Sam Koshy Order on Board 13/11/2019 1.

The issue involved in the present writ petition is in respect of the land situated in Village Khamtarai at Plot No. 40, Khasra No. 559/1, Patwari Halka No. 25/17, R.I. Circle, Bilaspur, Tahsil and District Bilaspur. 2.

Facts of the case are that both the petitioners have got their land purchased adjacent to each other, which is C/9 and C/10 in Khasra No. 559/1, measuring 0.015 and 0.022 hectares respectively. They had purchased the aforesaid land through a registered sale deed dated 18.7.2008 from one Dilip Kumar S/o Shri Nipendra Kumar after paying due consideration. The name of the petitioners have also been mutated in the revenue records. The petitioners have moved an application to the revenue authorities for demarcation of their land. The authorities concerned have also issued advertisements in this regard in the local newspaper calling for objections if any. However, though the authorities concerned had given the date for demarcation, for some reasons they did not appear for demarcation of the property and till date it has not been finalized.

3.

The petitioners therefore pray for a limited direction to the respondent authorities to decide the application for demarcation of their property at the earliest.

4.

The limited grievance or relief sought for by the petitioners is not opposed by the State Counsel.

5.

Accordingly, the respondents no. 3 to 6 are directed to take appropriate steps for getting the aforesaid property demarcated in accordance with law at the earliest and pass appropriate orders within a period of three months from the date of receipt of certified copy of this order.

6.

The writ petition accordingly stands disposed of with the aforesaid direction.
