Shri D. Wankhede, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 29/11/2018 The present writ petition has been filed assailing the order dated 06.10.2018 whereby the petitioner has been transferred from District Education Office, Raigarh to District Education Office, Bilaspur. 2.
The contention of the counsel for the petitioner is that in place of petitioner, respondent no.4 has been ordered to be transferred but
respondent no.4 has filed a writ petition before this Court i.e. WPS No. 6893/2018. This Court while disposing of the said writ petition had granted an interim protection to respondent no.4 from being relieved from Bilaspur. According to the petitioner, since the case of respondent no.4 is already pending consideration before the authority concerned, meanwhile, the petitioner should not be relieved from the present place of posting otherwise that can create further complication. 3.
Given the facts and circumstances of the case and also taking note of the interim protection granted in WPS No. 6893/2018 dated 12.10.2018, this Court is of the opinion that ends of justice would serve if the respondents are directed not to relieve the petitioner from the present place of posting i.e. Raigarh till the representation of respondent no.4 which is pending consideration before the State authorities is finally adjudicated. It is ordered accordingly.
