The present petition is only for seeking direction to conclude Criminal Case No.5431 of 2016 for the offence under Section 379 read with Section 34 of Indian Penal Code in Crime No.355/2016 by way of speedy trial.

It is contended that the petitioner is facing the charges under Section 379 of I.P.C. along-with other co-accused, however, he is absconding but the prosecution though were summoned and bailable warrant was issued nothing transpired and frequent adjournment was given without any reasonable cause, therefore, specific direction may be given to conclude the trial. 3.

Perusal of the order sheet filed shows that on 27.12.2017 the charges were framed thereafter the case was fixed for prosecution witness on 18.01.2018. Subsequently, it was listed for 19.02.2018 thereafter on 19.03.2018, 10.04.2018, 07.08.2018, 30.05.2018 & 07.07.2018 and it is contended before the Court that till today the trial is not concluded.

Perusal of the order sheet shows that summons though were issued but it was dealt in casual manner and even the direction to serve the witness through S.P. is not being followed as the statement has been made at the bar till today the trial is pending. 5.

Under the circumstances, it is directed that the trial against the petitioner shall be concluded within a further period of six months from the date of production of this order and the prosecution shall render all support to conclude the trial within frame work. 6.
