This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and no other bail application is pending before any other Court.

2. The applicants have been arrested in connection with crime No. 685/2018 registered at Police Station - Police Outpost -Naila, Police Station Janjgir, Civil And Revenue District Janjgir Champa (C.G.) for the offence punishable under Section 34(2) of the C.G. Excise Act.

3. Case of the prosecution, in brief is that on 02.11.2018, 5.040 country made liquor has been seized from applicant No. 1 and applicant No.2 was accompanying him, one motorcycle has been seized from his possession.

4. Govt. Advocate submits that one criminal case has been registered applicant No. 1 and four criminal case have been registered against applicant No.2.

5. Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if applicant No. 1 Ramnarayan furnishes two solvent sureties for a sum of Rs.25,000/- each along with a personal bond of Rs. 50,000/- to the satisfaction of the concerned Trial Court, he be released on bail. If applicant No.2 Bhushan furnishes one solvent surety for a sum of Rs.25,000/- along with a personal bond of Rs. 25,000/- to the satisfaction of the concerned Trial Court, he be released on bail.
