Ms. Sunita Jain, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 07.03.2019 The present contempt petition has been filed alleging the noncompliance of the order dated 18.07.18 passed by this Court in WPS No. 2487 of 2018.

The writ petition was filed by the petitioner claiming family pension payable to her on the death of her mother. According to the petitioner, since she was minor on the date of death of her mother, the pension was being received by her father Shri Nand Kumar Pandey. Now, that she has become major on attaining the age of majority and her father has since married another lady, therefore, the family pension payable to the petitioner

be paid directly to the petitioner. The State Govt. in the said writ petition had accepted the request of the petitioner and agreed to release the pension in the name of the petitioner. The writ petition was accordingly disposed of in the light of the reply filed by the State Govt. However, the non compliance of the said order has led to the filing of the contempt petition.

The respondent State has now come up with a reply that they have complied with the order so far as the role of the State is concerned and that the rest of the proceeding, if any, is upon the Officers of the State Bank of India to whom appropriate directions have already been issued by the State Authorities.

In view of the categorical reply submitted by the State Govt. and also the documents showing compliance so far as their part is concerned, this Court is of the opinion that no contempt is made out against the respondent. 5.
