This is first bail application under Section 439 of the Cr.P.C. preferred by the applicants before this Court and no other bail application is pending before any other Court.

2. The applicants have been arrested in connection with crime No. 36/2018 registered at Police Station - Gaindatola , District Rajnandgaon (C.G.) for the offence punishable under Section 34(2) of the C.G. Excise Act.

3. Case of the prosecution, in brief is that on 09.11.2018, 48 quarter country made liquor has been seized from applicant No. 1 and applicant No.2 was accompanying him. 4.

Govt. Advocate submits that no criminal antecedent of the applicants is reported in the police case diary.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if each applicant furnishes one solvent surety for a sum of Rs.25,000/- along with a personal bond of Rs. 25,000/- to the satisfaction of the concerned Trial Court, he be released on bail.
