Hon'ble Shri Justice Goutam Bhaduri Order On Board 14/11/2019
1. The order impugned is passed by the CEO, Zila Panchayat, Baloda- BazarBhatapara, whereby the petitioner have been imposed with a punishment of stoppage of two increments with non cumulative effect and he has been transferred to other High School, Kosmanda, Block Pallari, District - BalodaBazar, Bhatapara, C.G. It is contended that the transfer cannot be made by way of penalty as contemplated under Rule 5 of Chhattisgarh Panchayat Services(Discipline and Appeal) Rules, 1999.
2. Without going into the merits of this case, since, the appeal is provided under Rule 15 of Rule 1999 (supra) and according to the appendix as the order is passed by Zila Panchayat, the appeal would lie to the Division Commissioner. I am not inclined to entertain this petition as statutory appellate remedy is available.
3. The petitioner would be at liberty to raise all grounds in the appeal, if he chooses to file an appeal before the appropriate appellate forum.
