This is first bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 31.8.2018 in connection with Crime No. 329/2018 registered at Police Station- Janjgir, District- Janjgir-Champa (C.G.), for the offence punishable under Sections 148, 341, 294, 506(2), 323 with 149, 427 & 395 of IPC.

As per case of the prosecution, the complainant has been subjected to assault by a number of persons and during course of the assault, one golden chain of the complainant was robbed.

Learned counsel for the applicant submits that the applicant is resident of village Naila and he will regularly appear before
the trial Court and abide all the conditions. He prays for releasing the applicant on bail.

On the contrary, learned State counsel opposes the application for grant of bail.

Looking to the fact that the charge sheet has been filed and there is no possibility that the applicant will abscond, without further commenting on merits of the case, I am inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is allowed and it is directed that the applicant shall be released on bail on his furnishing a personal bond in sum of Rs. 25,000/- with one local surety in the like amount to the satisfaction of the concerned trial Court. He shall appear before the trial court regularly on each and every date, unless exempted from appearance.
