Learned counsel for the petitioner would submit that since petitioner's land has been acquired for construction of stadium at Naya Raipur, under the rehabilitation scheme the petitioner is entitled for allotment of house under the BSUP scheme, in
addition to the amount of compensation. He would also submit that in the list of beneficiaries under the BSUP scheme to whom houses would be allotted petitioner's name was included at S.No.48, however, when the final list was prepared petitioner has found that his name is missing as the same is not included in the said list filed as Annexure - P/5. 2.
Considering the entire facts situation of the case, particularly the first list prepared by the RDA vide Annexure - P/4, the writ petition is disposed of with a direction that in the event petitioner moves a representation before the respondent No.3 for allotment of house under the BSUP scheme within a period of one month from today the said respondent shall consider and decide the petitioner's objection on merits by speaking order at the earliest preferably within a period of next two months. If the petitioner is found entitled to such allotment for the reason that similar effective persons have already been alloted houses under the BSUP scheme, the respondent No.3 shall pass necessary orders in this regard.
