1. The grievance of the petitioner is that the petitioner has been transferred by order dated 20.08.2019 from District Office (Mining Branch) Raipur to District Office (Mining Branch) Gariyaband in the administrative ground.

2. It is contended that petitioenr is left with less then 2 years of service and petitioner's wife is mentally ill and the petitioner comes under protected category as he is a secretary of Chhattisgarh Pradesh Trithiya Varg Shashikiya Karamchari Sang. Therefore, as per the transfer policy the petitioner cannot be transferred. Learned counsel further submits that the petitioner was recently transferred to Raipur in the year 2017.

3. Perused the documents and also the Annexure P-5 where the petitioner has been shown to be the Secretary of Chhattisgarh Pradesh Trithiya Varg Shashikiya Karamchari Sang. Further Considering the medical grounds the petitioner is given liberty to make a representation before the Grievance Redressal Committee within 15 days from today and the representation so filed shall be decided by the Committee within a further period of 45 days from the date of receipt of a copy of this order.

4. In the meanwhile, the transfer order of the petitioner if not carried out shall be stayed till the representation is decided.
