The petitioner contends that the petitioner joined on 1/04/1991, he was regularized on 26/08/2008 and he retired on 30/06/2018 and as per the circular of the State dated 27/11/2018 (Annexure P-4) the gratuity amount has to be calculated from the date of appointment and not from the date of regularization and the petitioner has not been paid the gratuity. 2.
Since under the Payment of Gratuity Act, statutory authority exist, therefore the petitioner can approach the controlling authority under the Payment of Gratuity Act, 1972 and may place all the grievance. Since there is a statutory remedy available, therefore at this stage, I am not inclined to go into the matter.
