The grievance of the petitioner is that though the petitioner had retired from service on 29.02.1996, he has not been granted the benefit of revised pay scale in accordance with the 5th Pay Commission recommendations which came into force w.e.f. 01.01.1996. The petitioner in this regard has made repeated representations but the authority concerned till date has not taken any decision on his representation.

Given the nature of dispute and considering the recommendations of 5th Pay Commission which came into force w.e.f. 01.01.2996 and the petitioner retired subsequent to that i.e. on 29.02.1996, let the respondents 2 and 4 take an appropriate decision in the case of the petitioner and ensure that necessary instructions and orders be passed ensuring the implementation of 5th Pay Commission to the petitioner unless there is a specific order that the petitioner is not entitled for the same. Let this exercise be completed within a period of 90 days from the date of receipt of copy of this order. It shall be the responsibility of the petitioner to bring the order of this Court to the notice of respondents 2 & 4.
