Grievance of the petitioner is against the order dated 6/03/2012 whereby stoppage of one annual increment with cumulative effect was passed, one of the other person Ashok Kumar Sahu also challenged the said order who was also punished wherein in WPS No.4047/2012 on 1/02/2019 this court has passed the order and it was modified to the extent that the impugned order be read as stoppage of one annual increment without cumulative effect, instead of stoppage of one annual increment with cumulative effect. Thereafter, the petitioner has filed this instant petition for the similar relief and the petitioner prays that representation has been filed that issue of law has been decided by the court, therefore representation filed by the petitioner before the Commissioner may be decided.

Perused the order passed by the court in case of Ashok Kumar Sahu in WPS No.4047/2012 on 1/02/2019. Perusal of Annexure P-1 would show that Ashok Kumar Sahu was also punished alongwith the petitioner.

In case of Ashok Kumar Sahu same has been adjudicated by the coordinate bench of this court. Without any observation on the merit, Commissioner, Municipal Corporation, Rajnandgaon is directed to decide the representation of the petitioner which has been filed within a further period of 90 days from the date of receipt of the order. 3.
