This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicant has been arrested in connection with Crime No.426/2018 registered in Police Chowki Junapara, P.S. Takhatpur, District Bilaspur (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 01/11/2018, 9 bulk liters of hand made country liquor has been seized from the possession of the applicant. 5.

Counsel for the State submits that one criminal case under Excise Act has already been registered against the applicant. 6.

Looking to the above facts and circumstances of the case, the application is allowed. It is ordered that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- each along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he shall be released on bail. 7.
