Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 12-121. The applicant has preferred this anticipatory bail application under Section 438 of the Cr.P.C. as he apprehends his arrest by the police in connection with Crime No. 303/2017 registered in Police Station Dongargarh, Distt. Rajnandgaon for offence punishable under Section 419, 420, 467, 468, 471, 120B, 454, 380 read with Section 34 of the Indian Penal Code.

2. Perused the case diary.

3. Prosecution story in brief is that complainant Kriparam Sahu lodged a report against co-accused Jeevanlal Sahu that he had disposed of the disputed land impersonating him as complainant to the co-accused Kushalram Nandeshwar. Co-accused Amarlal, Kartikram and the applicant assisted the co-accused Jeevanlal Sahu.

4. Counsel for the applicant argued that the applicant is innocent and falsely implicated. He further submits that there is no legal evidence available against the applicant. His complicity has been shown in the memorandum of co-accused Kushalram Nandeshwar and Jeevanlal Sahu. Hence he may be granted anticipatory bail.

5. On the other hand, the State Counsel opposed the bail application.

6. As per photocopy of the order dated 5-3-2018 of ACJM Dongargarh, the charge sheet was filed against the applicant showing him absconded. After taking evidence the trial Court declared him absconded and issued permanent warrant of arrest.

7. Looking to these facts and circumstances of the case, this Court is not inclined to grant bail to the applicant.

8. Consequently, the MCRCA is dismissed.
