Indisputably, the civil suit between the petitioner and the respondent Nos.5 to 7 in respect of the land on which the alleged unauthorized construction is made is pending before the 10th Civil Judge, Class-II, Bilaspur.

Since civil suit is already pending adjudication, the petitioner is permitted to move an application for grant of temporary injunction in the pending civil suit. On such application being filed, the Trial Court shall consider and decide the same expeditiously, in accordance with law.

The writ petition is disposed of.
