Order rejecting application under Order 33 Rule 1 & 2 of the Code of Civil Procedure (henceforth "CPC') has been impugned in this writ petition, which is appealable under Order 43 Rule 1 (na) of the CPC, as such, the writ petition is held to be not maintainable. 2.
Accordingly, the writ petition is dismissed as not maintainable. However, the petitioner is at liberty to proceed in accordance with law. 3.
