This is the third bail application under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.302/2015, registered at Police Station-Dabhra, District Janjgir-Champa (C.G.), for the offence punishable under Sections 341, 395/34 and 294 of the IPC on the ground of delay in trial.

This application has been filed mainly on the ground of delay in concluding the trial as the applicant is in jail since 26.11.2015.

On instructions, Mr.Matin Siddiqui, learned Deputy Advocate General for the non-applicant/State, would submit that out of 24 cited witnesses, 19 witnesses have been examined, 3 witnesses are residents of Rajasthan and summons have been issued and effective steps are being taken to secure their presence and for one Nazir Khan, non-bailable warrant has been issued against him.

Be that as it may, the Superintendent of Police, Janjgir-Champa is directed to ensure the presence of remaining 5 witnesses expeditiously without further delay. Learned Second Additional Sessions Judge, Sakti is also directed to ensure the presence of remaining 5 witnesses and to conclude the trial without further delay as expeditiously as possible preferably within a period of six months from the date of receipt of copy of this order as the applicant/accused is in jail since 26.11.2015. 5.

With the aforesaid observation, the third bail application is disposed of.
