The grievance of the petitioner in the instant Writ Petition is that, the claim of the petitioner for compassionate appointment is pending consideration before the authorities for long, but till date no decision has been taken by the authorities.

The facts of the case is that, the father of the petitioner working as an Assistant Teacher under the respondents died in harness on 03/08/2007. On

the death of the deceased employee, the widow had moved an application with the respondents for keeping the post alive till the daughter of the petitioner attains the age of majority. The petitioner attained the age of majority on 11/12/2012 and thereafter she moved an application for compassionate appointment which till date is pending consideration before the authorities.

Given the fact that the department has not taken a final call on an application of the petitioner which is pending before them, the instant Writ Petition stands disposed off with a direction to the respondents No. 3 & 4 to take a decision at the earliest.

It is made clear that, while the claim of the petitioner is decided, the respondent authorities would keep in mind the recent decision passed by the division Bench of this Court in the case of Pushpendra Nath Sonesare v. State of C.G. & Anr. [WA No. 537 of 2015 d/on 10/09/2018] and also the judgments passed by this Court in the case of Digeshwar v. State of C.G. [WPS No. 4136 of 2012 d/on 19/11/2018] and Raksha Dubey v. Director, Sericulture, Raipur & Ors. [WPS No. 7564 of 2018 d/on 19/11/2018].

Let this exercise be done within a period of 3 months from the date of receipt of the copy of this order.
